Companies’ BEE scores declared invalid for tenders

VAAL TRIANGLE - The Court of Appeal ruled yesterday that it is invalid and unconstitutional for state-owned enterprises to apply black economic empowerment (BEE) requirements to tenders in public procurement. The court found that the Preferential Procurement Regulations of 2017 conflicts with the Preferential Procurement Policy Framework Act of 2000. The CEO of the Business League, Piet le Roux, welcomed the ruling. The regulations have been suspended for 12 months so that the Finance Minister, Tito Mboweni, has time to amend the law.
