Emfuleni petitions court judgement that allowed Eskom to attach its bank account

VAAL TRIANGLE - The Emfuleni Local Municipality has petitioned the Supreme Court of Appeal after the Gauteng High Court handed down a judgement on a repayment agreement matter between Emfuleni Local Municipality (ELM) and Eskom, which led to attachment of Emfuleni’s municipal current bank account. ELM said in a statement the courts ruled in favour of Eskom on Thursday, 02 September 2021, but Emfuleni’s application for leave to appeal in a bid to effectively halt the bank account attachment was unsuccessful. Therefore, the municipality petitioned the Supreme Court of Appeal. ELM says it is in this light that the municipality views this execution by Eskom as premature, because the matter is yet to reach its logical conclusion before the court of law.The municipality has further approached Eskom attorneys and filing of necessary documentation for submission is underway. The aim is to ensure that the attachment of the bank account is lifted, which will help ensure that the municipality continues to deliver services to its consumers as mandated. ELM said it remains committed to resolving this matter amicably in the interest of its consumers. The municipality is confident that the appeal process will be in favour and is pleading for patience from all consumers while efforts to find a lasting solution to this matter continue.
