VAAL TRIANGLE - The Johannesburg High Court delivered a groundbreaking judgement for parents, ruling that any parent is entitled to four months parental leave. The court ruled that when it comes to maternity leave, the Act unfairly discriminate against mothers and fathers, surrogate parents, and those who adopt children. The court has declared Sections of the Basic Conditions of Employment Act and the Unemployment Insurance Fund Act unconstitutional. The declaration of invalidity has been suspended for two years to give parliament time to correct the legislation. In the meantime, Judge Roland Sutherland has ruled that all parents are entitled to four months of parental leave if they contribute to UIF benefits.
